Who sells them

The same OCM file lists 3,009 businesses in 487 cities licensed to sell hemp-derived THC products: liquor stores, taprooms, grocery and convenience stores among them. 535 hold an on-site consumption endorsement, so they can serve drinks for customers to drink on the premises. How much THC a drink can contain

A single-serving hemp THC beverage may contain no more than 10 mg delta-9 THC. Since August 1, 2026, the packaging rules also allow resealable, child-resistant multi-serving bottles of at least 750 ml with no more than 5 mg per serving and no more than 17 servings, which caps a bottle at 85 mg.

Drinking them at a bar or taproom

Hemp retailers that also hold a liquor on-sale license are entitled to an on-site consumption endorsement, and since May 27, 2026 OCM may also issue one to other hemp retailers that submit proof of liability insurance. Beverages may be served out of the can if the label information is posted, but not from multi-serving bottles, and drinks designed or reasonably expected to be mixed with alcohol may not be sold.

Hemp THC edibles

Hemp-derived THC edibles (lower-potency hemp edibles) may have no more than 5 mg delta-9 THC per serving and 50 mg per package. They are sold to adults 21+ at licensed hemp retailers such as liquor stores and convenience stores.

What changes on December 11, 2026

A federal law narrows “hemp” so that final products with more than 0.4 mg total THC per container no longer count as hemp, and a September 2026 funding law moved most of that change to December 11, 2026. Dates, exceptions and the statute text: federal hemp THC changes.
